Carolyn Daley Scott and Brian LaCien of Power Rogers were involved in the filing of a complaint in the Northern District of Illinois, Eastern Division seeking nationwide class action status to represent 500,000 estimated individuals across the country who may have been defrauded by Volkswagen Group of America.
Brian and Kristen Hellweg, whom the complaint was filed on behalf of, purchased a Volkswagen SportWagen vehicle under the assumption that it would provide the best possible diminishment of pollutants. Recent accusations reveal otherwise.
Volkswagen officials recently admitted that some of its diesel cars were programmed to detect when emissions were subject to testing so that vehicle equipment could reduce emissions during this time. At other times, when the vehicles weren’t having their emissions tested, they produced up to 40 times the approved amount of the pollutant nitrogen oxide. According to Volkswagen, 11 million cars worldwide are affected by the diesel deception.
The complaint describes a “defeat device,” which Volkswagen allegedly implemented into its vehicles’ software to deceive the Environmental Protection Agency’s emissions testing. The attorneys at Power Rogers see this scandal as similar to what may have happened with the Takata airbags. Takata and various vehicle manufacturers are facing accusations that they knew about the issue for years but never admitted it to the public.
