Crosswalk Accidents

Were You Seriously Injured In A Car Accident?

Pedestrians deserve the same level of safety as anyone else, but they lack the same level of physical protection drivers enjoy inside their vehicles. According to the Centers for Disease Control and Prevention (CDC), an estimated 129,000 pedestrians required emergency care after being involved in a car accident in 2015 alone, and the National Highway Traffic Safety Administration (NHTSA) reported that another 5,376 were killed in vehicle crashes that same year (PDF).

Illinois Laws Protecting Pedestrians

625 Ill. Comp. Stat. § 5/11-1002 makes clear that pedestrians have the right of way when using a crosswalk. In particular, Illinois law directs that:

  • If there is no traffic control signal at the crosswalk or if it isn’t working, any oncoming vehicle must come to a complete stop and allow the pedestrian to cross the street when they are on the same half of the road, or when the pedestrian is close enough to the driver’s half to be in danger if the driver continues to move.
  • Pedestrians can only enter a crosswalk when their movement will place them in the path of a moving vehicle close enough to be an immediate hazard.
  • Oncoming vehicles cannot overtake and pass a vehicle stopped at a crosswalk or unmarked crosswalk at an intersection to allow a pedestrian to cross.
  • Drivers must yield the right-of-way to pedestrians when there is a flashing red signal or stop sign in place at a marked crosswalk or intersection.

Common Questions Related to Pedestrian Accidents

  • What Kind of Compensation Can I Receive?

A: The circumstances and types of damages surrounding your case determine what type of compensation you may be able to receive. After a serious personal injury, you may be able to seek financial compensation for your medical expenses, ongoing medical care, doctor’s visits, as well as emotional damages.

  • Who is Responsible for My Accident?

A: Generally, responsibility for your accident and injuries lies with the party who caused it. This is called “liability,” and the liable party is the one who is at-fault for the accident and related damages.

  • Do I Need to See a Medical Professional?

A: Yes. Even if you don’t feel like your injuries are serious, it is important to seek medical help. Depending on the type of injuries you suffered, it’s possible that some symptoms may not manifest themselves until days or even weeks after the initial trauma. Additionally, doctor’s visits and hospitalization records may be an important part of your case.
