On July 12, 2018 plaintiff, age 78, a part-time cardiologist, underwent spinal surgery without complication. However, post-op, while he was in the PACU, a resident anesthesiologist improperly administered the wrong medication and an incorrect dosage of Remifentanil–which caused plaintiff to suffer cardiac arrest and a mild brain injury. Plaintiff suffers from confusion, depression, and lack of concentration following the event. This was the highest reported recovery for traumatic brain injuries of a plaintiff over the age of 70. On January 24, 2017, the plaintiff’s husband underwent a bilateral total knee arthroplasty. He was morbidly obese and had a history of high blood pressure and sleep apnea and was in the highest risk category for venous thromboembolism (VTE). The next day, he exhibited oxygen desaturation, tachycardia, diaphoresis, and other signs and symptoms of a serious condition. He had a physical therapy session, then a few hours later, he collapsed and died as a result of a pulmonary embolism. Co-counsel with Larry R. Rogers, Jr.

This case concerns the death of A. M., a 23-year-old college student found unconscious at a bus stop near her home. She was transported to Roseland Hospital, where she passed away on December 7, 2016. Her autopsy listed the cause of death as a probable seizure disorder.

As an infant, A. M. experienced brief “episodes of tensing up” that resolved by age one but recurred after her 18th birthday, sometimes following head bumps. A diagnostic workup at that time was negative, but she continued reporting episodes to her doctors.

In June 2016, A. M. saw her primary care physician, Dr. G. S.-E., at Mile Square Clinic and was prescribed Wellbutrin for mild depressive symptoms. In September, her dosage was increased to the maximum therapeutic level. Following Thanksgiving, A. M. was found unconscious at home, initially diagnosed with a ruptured ovarian cyst, then transferred to Advocate Christ Medical Center. Medical staff were informed of her seizure history and Wellbutrin use, but no neurological workup was performed, nor was she warned about potential risks.

Lawsuits were filed against the United States of America for her care at Mile Square Clinic (settled 2023 for $900,000) and against Advocate Christ Medical Center (resolved January 2026 for $1,500,000). Total settlement: $2,400,000.

(2017) Medical Malpractice: A 47 year old female presented to the emergency department at MacNeal Hospital and her evolving heart attack was not timely recognized nor treated. Instead, she was treated for GERD resulting in an approximate seven hour delay in diagnosis, ultimately leading to significant heart muscle damage and her death. She was survived by her husband, who passed away during the pendency of the case, and two adult children. Co-counsel with Joseph A. Power, Jr.

On January 2, 2015 full-term pregnant mother presented to deft community hospital, and was admitted overnight. Personnel there contacted a governmental hospital for a maternal/fetal medicine consult because of staffing limitations. Although fetal monitor strips were Category III, the mother was discharged home based on the medical advice that was received. The next day, the mother went to a major metropolitan hospital due to decreased fetal movement. However, more than 3 hours elapsed before an emergency C-section was done. As a result, the F-newborn sustained a brain injury, evidenced by permanent mild developmental delays and attention deficit disorder. (2020)

(2015) Medical Malpractice: 19 year old female presented to Swedish Covenant Hospital with complaints of constipation, abdominal pain and abdominal swelling. She was admitted and was followed by a specialist in general surgery, and a specialist in gastroenterology. During her hospitalization, other than the CT scan performed on her arrival to the hospital on October 30, 2010 radiographic surveillance did not occur again until after a rapid respiratory response was called on November 3, 2010. Hours later on November 3, 2010, she coded and passed away. The cause of her death was toxic megacolon, a condition which required surgical decompression as bowel toxins migrate through the bowel wall causing sepsis. Defendants failed to timely perform surgery and failed to intervene in the face of sepsis to prevent septic shock and death. Source control by surgery was not obtained. Co-counsel with Joseph A. (2018) Medical Malpractice: Baby boy was born April 29, 2016. He returned to a local community hospital on May 5, 2016 with fever, not feeding well and appearing lethargic. Agents/employees of a local pediatric hospital failed to recognize and treat Herpes Simplex Virus with a medication called Acyclovir. Acyclovir was eventually administered 42.5 hours after his initial presentation. He was later transferred to a pediatric hospital where he passed away on May 13, 2016. He is survived by his parents and his minor brother. Co-counsel with Joseph A. Power, Jr.

This cause of action related to brachial plexus nerve injuries suffered by the minor at birth.   Plaintiff alleges that a shoulder dystocia existed at the time of birth, which the delivering physicians failed to recognize and therefore applied excessive, downward traction of the minor’s head, causing permanent stretch and tear injuries to the nerves of her brachial plexus.  Plaintiff further alleged that had the shoulder dystocia been properly recognized, maneuvers to relieve the shoulder dystocia would have been applied and the dystocia relieved without any injury to her.
