On the front cover of the New York Times, they recently reported that the creators of the DePuy hip implant were aware of 40% of the failures that occurred with the device. According to the New York Times

Newly disclosed court records revealed that an internal analysis conducted by Johnson & Johnson in 2011 not long after it recalled a troubled hip implant estimated that the all-metal device would fail within five years in nearly 40 percent of patients who received it.

The DePuy hip implants were created with a metal-on-metal stem and neck to offer more flexibility and to be more accommodating to younger hip replacements. However, the design actually led to cases of severe pain or inflammation, infection, metallosis, immobility, and dislocation. Because of the effects, DePuy had to recall these items.

A trial is slated to begin Friday in California Superior Court. The court will consider what officials at the DePuy Orthopedics division knew about the side effects of the devices before they were recalled. The court will also determine what steps, if any, the company took to rectify the situation.

DePuy is a multi-national company owned by Johnson & Johnson that sells products used for repairing and reconstructing joints and other portions of the skeleton. It is the largest maker of replacement hips worldwide. The ASRs manufactured by DePuy belong to a category of devices known as “metal-on-metal” implants. Surgeons have largely abandoned such devices in standard hip replacements because their components can grind together, generating large amounts of metallic debris that damages a patient’s tissue and bone.
