Illinois Cellphone Law Regarding Texting And Driving

According to 625 ILCS 5/12-610.2.

A person may not operate a motor vehicle on a roadway while using an electronic communication device.

A person can be charged with aggravated use of an electronic communication device when their use of the device causes an auto accident that results in disfigurement, permanent disability, great bodily harm or death to someone else.

The at-fault driver can be charged with a Class A misdemeanor if the crash results in a serious injury, which is punishable by up to one year in prison and a fine. If the crash results in a fatality, the at-fault driver can be charged with a Class 4 felony, which is punishable by one to three years in prison and $25,000 in fines.
