(2003) Automobile: 23 year old male was killed when his motorcycle encountered power steering fluid which had leaked from a truck that had been negligently maintained. The sole heir in this wrongful death action was the decedent’s daughter who was not born until six months after her Dad’s passing.

Result: $2,000,000.00

Plaintiff, age 59, and her daughter, age 21, were passengers on a tour bus traveling on I-70 in Fayette County when the bus driver struck an overturned tractor trailer that was laying across the Interstate. The mother suffered a concussion and contusions to her head and left knee. The daughter sustained an ankle fracture that required an open reduction internal fixation procedure. Plaintiffs alleged the bus driver was negligent in hitting the truck sitting in the Interstate when others drove around it. They also claimed the truck driver fell asleep at the wheel and rolled his truck. (2015)

D.Z. v. Commercial Vehicle Driver

D.Z., an 8 year old boy, had his hand ran over by a commercial vehicle while operating his bicycle and attempting to cross a street in his neighborhood. He suffered a degloving injury to his right hand that required multiple surgeries. Defendants claimed that D.Z. swerved in front of the vehicle and fell off of his bike, causing his hand to end up under the rear tire. After Defendants initially refused to engage in settlement discussions, James prosecuted the case and ultimately was able to secure a $1,500,000 recovery on behalf of the young child.

S. R. v. Patricia Duffy

Automobile Negligence: The minor plaintiff was injured by a left-turning vehicle when struck in a marked crosswalk, sustaining road rash injuries to her back, left scalp, and ear, resulting in permanent scarring. Defendant-driver’s insurance paid its entire policy after Plaintiff’s deposition.

Settlement: $1,250,000.00

N.G v. Thoms

Motor vehicle settlement. The Plaintiff N.G. was operating her vehicle westbound on Route 60 near the intersection of Route 43 when the defendant, who was driving eastbound on Route 60, turned left and struck N.G.’s vehicle. Defendant failed to yield the right of way causing the accident. N.G. suffered a right patellar fracture, a right tibial and fibular fracture, and right middle and medial cuboid fractures. Her injuries required surgical intervention, hospitalization for 13 days, in home health care, and extensive physical therapy.

R.F. v. Gercek, et al.

Motor Vehicle negligence settlement. On September 12, 2007, the Plaintiff, R.F., was a 74 year old female who was a pedestrian crossing Delaware Street near 175 E. Delaware in Chicago, Illinois when she was struck by the van the Defendant, I.G., was operating in reverse on Delaware Street while attempting to make a delivery at the John Hancock Building. The Plaintiff sustained a traumatic brain injury, oral injuries necessitating multiple oral surgeries, and knee and hip injuries as well.

(2009) Auto: 21 year old female (survived by parents and sister) died when the SUV she was driving was struck by a vehicle which had a green light as she made a left turn.

Result: $1,000,000.00

P.Z. v. Commercial Motor Vehicle Driver

P.Z. was on his way home from work when he was T-boned at an intersection after the truck driver drove through a red light.  Defendant initially disputed that the light was red, claiming that it was P.Z. who entered the intersection unlawfully.  After initially refusing to settle, James was able to secure a $700,000 recovery on the eve of trial.

P.T. v. Hirota, et al, 08 L 004492

Motor Vehicle negligence settlement. On January 22, 2008, the Plaintiff, P.T., was a 47 year old female who was driving eastbound on Dundee Road in Arlington Heights, Illinois proceeding through the intersection of Dundee Road and Wilke Road when the Defendant, S.H., turned left from westbound Dundee Road and struck the Plaintiff’s vehicle. The Plaintiff sustained right tibia and fibula fractures requiring an open reduction internal fixation.

R.T. v. Confidential Defendant (2022)

James Power secured a $550,000.00 settlement on behalf of Plaintiff who was sitting in traffic when her vehicle was struck from behind by a semi-truck. Plaintiff suffered injury to her back which resulted in a single level fusion.
