J.L. v. K.M. (2021)

James Power secured a $500,000.00 settlement on behalf of plaintiff, who along with her three children, were stopped at a stop sign when their vehicle was rearended by a teen driver who was using her cell phone. The collision resulted in the death of one of Plaintiff’s minor children, as well as significant injuries to Plaintiff and her two other minor children that were also in the vehicle. The Defendant only carried $50,000.00 in auto insurance coverage, while Plaintiff carried $500,000 in uninsured/underinsured motorist coverage. Defendant settled for limits of her policy coverage and Plaintiff’s underinsured motorist coverage paid the remaining amount.

HP v. City of Chicago, a municipal corporation

(2003) Automobile (Wilful and Wanton): 33 year old male was struck by police vehicle which was traveling on the wrong side of the street without lights and sirens when responding to a call regarding a man with a gun, ten blocks away from the accident scene. Plaintiff suffered fractures of the right and left tibia and fibula and jaw. Co-counsel with Larry R. Rogers, Jr.

Result: $450,000.00

Confidential v. Confidential

This case involved a rear seat passenger who suffered a concussion following a collision at an intersection.  After an initial offer of $6,000, James prosecuted the case and ultimately was able to secure a $400,000 recovery on behalf of his client.

C.S.W. v. Arreola – State Farm Insurance Company for Underinsured Motorist Claim

Motor vehicle settlement.  C.S.W. was a pedestrian in a crosswalk struck by a vehicle being operated by Arreola who was unable to see due to her windshield being “fogged up.” C.S.W. suffered a bilateral fracture of the right and left humerus, periorbital hematoma resulting in temporary left visual field deficits, and a concussion.

R.J. v. Vito Migliore

Auto: The Plaintiff, a 50 year-old male, was riding his bicycle in a designated bike lane on Southport Avenue when he was struck by Defendant’s vehicle, which was making a left turn into a CVS parking lot. The Plaintiff sustained injuries including a dislocated shoulder and rotator cuff repair. Co-counsel Joseph W. Balesteri.

C.D. v. Teen Driver (2021)

James Power secured a $200,000.00 settlement on behalf of Plaintiff, a 77 year old female, who was driving on Waukegan Road when a vehicle unexpectedly pulled out from the Deerfield High School Parking Lot and struck her vehicle. Plaintiff suffered a fractured sternum and three broken ribs.

F.B. v. First Luna Taxi Cab Co.

Automobile collision: The Plaintiff was a passenger in a taxicab that ran a red light and was involved in a collision. Defendants admitted liability shortly before trial. Plaintiff suffered a post-concussive syndrome. The offer prior to trial was $60,000.

L.B v. Burt

Motor vehicle settlement.  L.B. was a pedestrian in a crosswalk when she was struck by a motor vehicle being operated by Defendant Burt on February 23, 2019. L.B. sustained a closed fracture of the right tibia and fibula which required surgical intervention. Insurance policy limits of the defendant were paid.
